it is certainly NOT a formal or syllogistic fallacy. AFAIK that leaves only the option of it being an informal fallacy, but as the OP observes it is actually inductively correct (and IMO correct for the correct reasons) in a non-zero non-insignificant number of cases.

in my mind that makes it NOT a fallacy, but rather a form of inductive rather than deductive reasoning that is not necessarily 100% reliable in all cases (but then, 100% reliability in reaching the same result consistently is something we demand of deductive reasoning, not inductive reasoning in general)
