But seriously, if this was a logical fallacy it would be tested on the LSAT.

It is a logical fallacy, but not an empirical fallacy. Logically, we can draw the line wherever we want. But as a matter of practice and human nature, people are more willing to go 2 feet once you go one foot.

Virtually all everyday arguments are logically invalid, even if they're inductively strong. Textbooks that treat it as a fallacy always treat it as an informal fallacy, which OP rightly criticizes

I'm not sure what you mean in saying 'it is a *logical* fallacy.'

it is certainly NOT a formal or syllogistic fallacy. AFAIK that leaves only the option of it being an informal fallacy, but as the OP observes it is actually inductively correct (and IMO correct for the correct reasons) in a non-zero non-insignificant number of cases.

in my mind that makes it NOT a fallacy, but rather a form of inductive rather than deductive reasoning that is not necessarily 100% reliable in all cases (but then, 100% reliability in reaching the same result consistently is something we demand of deductive reasoning, not inductive reasoning in general)

These are good points and I think we are mostly in agreement. I meant it was fallacious to the extent it is used to argue or imply that if you do X then X+1 is inevitable. That doesn't necessarily follow.

I also think I skipped over "always" when reading the thread title.

it's only a fallacy if it's wrong. one of those things that's only proven post facto. which makes kind of useless.

btw, most logical fallacies are flame in the rigid sense and are perfectly valid arguments in certain cases, or can at least be heuristics.
