i don't have a strong opinion on whether this is worthwhile. near-frivolous strategies are employed all the time in large civil cases. i'm just saying it's not really a strong indication that he couldn't post if he runs out of options. there are plenty of wealthy trumpmos that would certainly pledge the securities necessary to secure these securities in exchange for a secured interest in some of his property. the article says he's been having trouble securing it because surety companies won't use property as collateral.
it seems clear to me that he is attempting to avoid or reduce the surety to avoid having to sell property or do other transactions in order to post it. i don't think there is any chance he couldn't come up with it.
why don't you go on the record -- do you think this appeal will fail because trump is absolutely unable to post the surety? do you think NYS is going to start levying him to satisfy the judgment? |

A related issue is that many would not accept real estate as collateral--because, well, those are *already* leveraged, so there's no equity in them. In other words, I think it's entirely right that it's a "strategy" to try to avoid it. But I think it's also right that the fact that no one would issue the bond because they doubt his ability to get $454B in unencumbered liquidity even after real estate sales is significant. |

Without a stay pending appeal it'll take five minutes for the AG to print out and send information subpoenas and account restraints to every financial institution in the US. That freezes everything. Levying the accounts is also pretty easy (and plenty of NY Marshal will be licking their chops on that). Taking the properties is tougher because you usually have to start an Article 52 special proceeding for that and Trump could buy time in that. But appeals take years in NY to get a decision.
Note he did file a bond in the defamation case. |
