Client went in for a hip replacement, doctor performed a completely different procedure than what was consented to pre-op and completely fucked it up. Client woke up from surgery with a 1" discrepancy in legs and permanently hobbled now.

Hi Peter. I think you mentioned this case before awhile ago. I suggested you pass on it but I’m sure I was wrong. Do you have two SOC surgeons on board? The lack of informed consent claim is usually pretty hard to prevail on but if you pled it as battery it must have been egregiously outside the scope of consent. The damages sound less than ideal frankly but I’m sure you can develop that.

The big thing at this point: do you have two standard of care surgeons who would qualify as experts in court in California.

Yeah. That's paid for at least. I'm planning to be one of those broke people living in a fancy house driving a 10 yo Range Rover and a 20 yo BMW, both with all the "check engine" lights constantly flashing.

At least I have my dream surfboard.
