Never a good idea to give negative recommendations unless something like embezzlement was the cause for dismissal and they were caught red handed. Creates too much liability for the employer. Remember this when coaching clients. BTW - most fortune 500 HR Departments don't give negative recommendations - they just say something like, "so and so worked here from X to Y in the position of Z." That is all they'll say and that is code for don't hire this fucking guy.
"A former employee sued her former employer for unlawful retaliation under Title VII. At trial, the former employee demonstrated the former employer provided negative recommendations to a prospective employer in retaliation for the employee's prior discrimination complaints. The jury found in favor of the employee and awarded her $25,000. However, the trial court rejected the verdict because it found she did not prove that due to the negative references she suffered an adverse employment action. According to the trial court, in order to make this showing, the employee had to prove that she would have received the prospective job but for the employer's negative references.
The Tenth Circuit held that the district court erred in requiring the former employee to meet this standard. The Tenth Circuit lessened the employee's burden of proof, holding that in order to prove an adverse action occurred because of negative references, the employee must only show that the negative references would likely preclude her from obtaining employment with the prospective employer. In this case, the prospective employer testified that negative information would have disqualified a candidate for the position (but the negative references were not the reason for its decision not to hire the former employee – the prospective employer claimed that the plaintiff was not hired because her long fingernails would have interfered with her typing speed!). The Tenth Circuit found the former employee proved that she suffered an adverse employment action due to the former employer's negative references. Accordingly, it reinstated the $25,000 jury verdict in favor of the employee."

Not sure about that. This isn't a classic no-offer situation. This was a mid-summer firing. And there may be a reason, depending on what happened that got him fired, why the firm doesn't want any of it's current employees endorsing the guy in their capacity as a firm employee.
As for the unsolicited negative recs, I have no idea how he could know that. Chances are, it's made up, just like his claim that the firm fired him as part of a conspiracy.

12(b)(6)? In state court? That is not the credited response. Not sure about DE state procedural rules, but most states do not have motions to dismiss with as much teeth as the FRCPs. Still, the only claims not clearly subject to demurrer are IIPEA and conspiracy.
Edited: DE state court.
Edited: conspiracy generally requires an agreement, intent, and an underlying wrong. Some states do not even require participation to identified specifically. Agreement can be generally averred.

This is jogging a memory, but I'm not sure if it's a valid one (the age and the HAM radio thing are sparking it, if that helps anyone). About two years ago, wasn't the ridicule-of-the-moment a non-trad male who received no callbacks and then proceeded to write a very detailed letter to the firms outlining the fact that he once worked for some district county juvenile court judge and she could vouch that his legal writing was "among the finest she'd ever seen?"

The Real Story: This is a dumb and slightly deranged white guy who, through some bizarre rationalization, checked the african-american box and got some massive AA to get into Michigan.
He got terrible grades at Michigan because he wasn't qualified to be there in the first place. However, he was still able to land a job, albiet a shitty one, purely off the fact that he was a Michigan student.
At his job, he proceeded tell extremely racist jokes at inappropriate times, thinking he could get away with it because he was 'african-american.' Too bad everyone else correctly saw him as 'white.'

This is so incredibly wrong. Many schools, and also the government, actually have a definition for what it means to be Native American (must be recognized by a tribe or have 1/16 native american blood, or whatever).
Neither law school nor the government, however, have a definition for "hispanic" or "african-american" - it's 100% self-selection. It's really, really, hard to prove someone isn't african-american or hispanic if they claim they are, because they can just say "yeah, my great-great-grandmother was black, so I consider myself black." There is no 1/16 rule or anything for african-american or hispanic.

The supervisor told Lake she had been hired to meet an affirmative-action goal for American Indians, and that if she could not prove her race, the job offer would be withdrawn.
The next day, Lake brought in documents showing her great-grandfather was a member of the Chickasaw Nation.
But her supervisors told her she needed proof that she was a member of a tribe - and that she had a month to produce it.
She didn't. She lost her job.
Lake has since learned she is 1/128th Chickasaw Indian, enough for her to get a tribal-affiliation card, sufficient documentation for the state.
