Another good point. No 'the following fact pattern is relevant to #19 and #20' so you could read one paragraph for 2 questions. No really short questions. I was ripping through 50 questions in a little over an hour on the practice questions. I took 2 full hours today and just about all of it was devoted to reading.

i thought it was pretty hard. I ran into a bunch of questions where I thought either answers could have been ok under weird scenarios that weren't mentioned in the facts. I was avg 43-46 out of 60 on BarBri. I would have to say that I thought I knew what I was doing when I did the Barbri questions. However, I was guessing on every other question between 2 choices? So assuming i'm 50-50 on my guesses, I got 2/3 of the questions right? Hopefully that is enough for an 85 for this exam.

Same here. When I did BarBri tests I was usually able to finish each test in 75-90 minutes and ran into very few questions where I was stuck between two or more answers. Today I had to skip and go back to about 20-25 questions and needed the full 125 minutes.

You think you had it rough in there....

I was slogging through it, thinking it was a bit harder than the practice questions. I check the clock after I finished the first 10 - 25 minutes burned.

I thought I sped up a bit, I was about 3 questions behind at the half way mark....

Then suddenly with 10 mins left I realized that I was only on 48, not 58! I panicked, tried to pick off the shortest ones... Then I filled in random responses for about 8 questions. I glanced at 3 of those for a few seconds and just threw down the one that looked best.

Ya, I'm screwed.

What number right usually works out to an 85? Not that it matters.

If I remember one thing from my PR course, it is that the rationale for the prohibition on solicitation is because they are afraid of lawyers wielding their superhuman abilities to persuade weak and pathetic nonlawyers (at least according to my prof). I seem to recall its okay because the fact pattern explicitly stated that the transaction was completely fair. From Bar-bri I remember there were 2 exceptions to the bar on business with a client:

i. Ordinary transactions

ii. If the transaction/business dealings are completely fair and reasonable.

a. Terms of transaction must be fair and reasonable,

b. Terms disclosed in writing, in words that the client can understand,

Nope. Generally its insider trading (you probably have insider info). BUT, in this case the problem explicitly stated that no securities laws were being violated.

In addition, lawyer got informed consent AND purchase on the open market and not directly from the corporation.

i'm curious about the general MPRE-is-a-joke-so-cram-2-hours-and-be-set mentality that exists on the board.

i was surprised by the number of people at the test center who mentioned it was not their first time taking the exam.

historically, when scores are released, how many xoxo posters admit that they failed? while everyone complains that they bombed, maybe people who bomb don't come back and update xoxo on their failure?

You guys are idiots. The passing score for most jurisdictions is the equivalent of like the bottom 20%. The the bottom 20% of all testakers, including people from unaccreditied and correspondence schools, and a bunch of old lawyers who have to retake after being sanctioned by their state bar. I believe it is about 15 points for each standard deviation. So you have to be bottom 15% to score below an 85 scaled score. With that said, look to your left, look to your right, look forward and back. Safe odds that you or one of those people you just looked at failed the mpre.

i thought the california state bar put the fail rate at closer to 25%. cal bar used that as reason to propose an increase of passing scaled score to 100. i'm glad that didn't happen.
