says it gives him a “reset” for the jury.
If he has to clean something up in closing He has used the line “regardless of what the bearded fellow asked the other day” and the jury always laughs and even the judge.
defense counsel objects but there is no legal ground to do so.
He has asked for a continuance mid trial if he uses the trick but needs to do another reset so he can grow it back.
Is this shrewd?

he gets overruled all the time (this is 100% true).
he was overruled 22 times in 20 minutes recently for asking wildly leading questions on direct.
he basically makes up stories on cross and ends with "isn't that right?"
it was honestly embarassing for me bc it was a fed court case. I told him that we should do a CLE on the rules of evidence and he said "you can review the rules of evidence, I'll review the 48 laws of power"
