I've looked into the feasibility of challenging VICP/PREP Act on 7A grounds, but the case would have to be worked from the ground up as impact litigation. You would need a client who's willing to be an activist and you need expert witnesses. Lawyers would have to do it pro bono or have a nonprofit backing them. If anyone can land a client who's willing go full Rosa Parks, I know at least two people who probably meet the Daubert standard and would be happy to testify, probably for free.
