Whether the UK company that owns OnlyFans is subject to personal jurisdiction in CA.

(We've sued them under CA's Automatic Renewal Law for automatically renewing "Fans'" subscriptions to "Creators" without disclosing that it'll be a recurring charge. Our kindly elderly judge determined that they're not subject to Jx in CA because they hadn't "specifically targeted" California consumers)

Lol jfc. Are there still open questions like *that* on internet minimum contacts? Just set up your site to not allow California IP addresses, like how when I take depos in red states now I have to use my imagination to jerk off because porn sites want my DL and birth certificate.

It's not *actually an open question, it's just a kindly elderly judge who assumed that Orrick biglolyers probably know a lot about jurisdiction, so we should do what they say.

Lol, yeah. Our SOL goes back to summer 2018. By the time of judgment it's going to be 10 years of all auto-renewals in CA. It'll be well over $1B by then. Unfortunately our only claim is under the UCL so it'll be a judge deciding, and obv he'll think of some way to pare it down, like perhaps to only the first renewal, and then say, "the user should have reviewed his cc statement and known better."

Tremendous lawyering. I have not thought about such personal jurisdiction issues in years and the deep analysis was both majestic and scholarly. I also thought that your short rebuttal that put the focus back on the subsequent conduct of the Defendant was superb. Laser focused. You came back into the ring like Mike Tyson and dropped the mic on that nerd lawyer.

What are damages like in Onlyfans-recurring-charges litigation? Do plaintiffs have a duty to mitigate?

On its face it's just restitution of the "unlawful" charges. We have Judge Breyer who is supposed to be unafraid of nuclear judgments, so we'll see what unfolds (there's surprisingly little caselaw as to whether at some point the consumer is required to review their charges and unsubscribe -- perhaps especially once they've first realized how it works)

The money has to go somewhere. It’d be weird for a person taking that moral view to conclude that it’s better for the pornographer to keep it than to give it back to the lonely masturbators and shut-ins.

Just rewatched this. And realized that the case will likely be decided by the height transition from 18:16 to 18:30: https://youtu.be/V3P2ZxZwI9E?t=1096

Esp at 19:11, when the video guy is like, "whoa, this is a Tall Man," and has to adjust the camera.

Basically game over.

This is just to establish that OF is subject to jurisdiction in CA. They've since changed their subscription process to more-or-less comply with the law, but there should still be tens of million$ in illegal charge$ that we can have refunded to the victims (minus 25% + costs).
