whether or not it's a good thing for the supreme court to rule by fiat is irrelevant. it's the objective situation that we have right now
they can either accept the responsibility to rule by fiat, or they can be selfish cowards and refuse to, which is what they have chosen

uh, yeah, in that system voting *is* irrelevant. that system in question? the system that we have right now, where the judiciary can simply declare anything that the elected president does "illegal" or "legal" as it wishes
the judiciary currently has all of the domestic sovereignty that is contained within the federal government. this is a fact. it's not me describing my hypothetical normative ideal. i don't like this state of affairs any more than you do!
given this state of affairs, the members of the head of the judiciary - the supreme court - should step up and take on the mantle of responsibility that has been given to them, for better or for worse
