I told her (the defendant) to reject the offer because the prosecution's case was weak (and I was skeptical about her making it on probation without pissing hot and getting popped for that). Pressure was really on after that because she had an out and I told her not to take it. Went to trial and copped that Not Guilty verdict. A couple of .08 or drug DWI's that were found not guilty but they definitely weren't 100% sober. Overcharges were more common but the ADA always came off those charges. Closest case to truly innocent was a federal DWI on a military base where client took ambien, drank a glass of wine and went to bed to later drive in her nightgown around the base at 3am. Judge found her not guilty by reason of lack of "autonomy" over her actions. Also had a few self-defense assault cases that were thrown out or found not guilty but they shared some responsibility in the altercation (http://www.autoadmit.com/thread.php?thread_id=5906591&forum_id=2:#50154146) |

There was absolutely no doubt as to what they had done. Furthermore a UST who gets good legal representation is only getting fast tracked to jail.
