To save the rest of you from watching: conviction was vacated due to a venue failure—government didnt show any nexus between the venue where he was prosecuted (NY) and where the offenses were committed (Puerto Rico)
The Court found that the government failed to prove that any essential part of the commodities offenses occurred in the Southern District of New York. Eisenberg executed all transactions from Puerto Rico. |
