My understanding is that the reason that male drivers earn more is because the best time to drive for Uber is when the bars close, and female drivers don't want to let a bunch of drunk randos into their cars. If female drivers suddenly start earning significantly more than their male counterparts once this change goes into effect, the male drivers might have a case. I'm not a constitutional lawyer, but my understanding is that gender-based laws get intermediate scrutiny rather than strict scrutiny for laws based on race. In addition to women being able to request a woman driver, you should be able to filter for drivers with ‘tags’ for interests similar to your own so that the chit chat with your driver is less awkward. For example, you could filter for “sailing”, “lacrosse”, and “Magic: The Gathering” and then you’d know that whoever your Uber driver is, you’ll be comfortable with them because you have shared interests to talk about.
