Covington & Burling LLP - Since you have failed to meet the conditions of the private offer of settlement I conveyed to your employment counsel Lindsay Burke, that offer has expired. Since several Covington partners and your crisis management team have viewed my LinkedIn Premium account with their personal pages, I trust that this message will find its way to the appropriate Covington decision makers.
Since you failed to meet my one prior condition for settlement, a conversation with Covington’s managing partner, Douglas Gibson or one of either Jim Garland or Lanny Breuer, my new terms for settlment are as follows:
1. $30 million - A representative amount of the profits that Covington’s partnership earned from the work of me and the one other Black associate I know who had a nervous breakdown because of Kyle’s abuse.
Please note that that $30 million should be paid in two increments of $15 million. The first $15 million should be made payable to Paul Bryant (in his personal capacity) and the second $15 million should be made payable to the Sponsors for Educational Oportunity Law program; in the case of the second $15 million payment, such payment shall be made into an account designated by Chauniece Davis, director of the Sponsors for Educational Opportunity Program.
2. $7 million - An amount representing the cost it will take to build a center for mental health and wellness at Clinton Baptist Church (my home church), which I will use to spiritually and mentally shed the trauma you have caused me and my good friend as Black associates at Covington.
3. $5 million - An amount representing a donation to the West Point boxing team, which I will coach while I recover from the trauma you have caused me.
4. The immediate termination of Kyle Rabe.
5. A public apology for the systemic failures of Covington’s woefully inept Corporate mergers and acquisitions practice in Washington, DC and the dismantling of such practice until a full independent investigation into the methods and manners of practice of the firm is conducted and a concrete plan of action administered and supervised by an independent third party selected by the ABA (excluding any Covington lawyers who hold ABA positions).
You have 24 hours to respond.
In the event you fail to respond, I will proceed with requesting that the executive administration launch an EEOC (or other appropriate) governmental investigation into Covington & Burling LLP.

How about Take Back NYU 2009?

Could the allegation that Covington only offered him 1 week of leave and resume writing services be true? Without, e.g., them also offering him 6 months of pay?
As much as there are many 120 aspects of biglaw, they are very generous when pushing someone out. Way more so than most private-sector employers. I remember a first year associate who wasn't cutting it, and the firm I worked at gave her 6 months of basically doing no work while she looked for a new job. And the rumor was that she could, at minimum, remain on unpaid leave and on the website for longer if it took longer.
Maybe it's different when someone is getting fired fired, instead of gracefully nudged toward the door.

My guess: He will get zero. Had he played his cards differently, he could have gotten 1 year's salary or something, which is like $450k these days.
Covington probably expects that he would get nothing if he got to a trial verdict, if he could even avoid losing on an MTD or MSJ, so there is no settlement value there, other than the avoided legal fees. His claim is, at least partially, self defeating: I wouldn't do my assigned work, so they fired me.
And he already publicized his claims, so there is limited value in paying him to go away quietly, unless there is some dirt that would come out in discovery, like partner time entries that say "2.8: Review and revise 10-K, hurl racial slurs at associate, obtain management committee approval for same."
And there is value in not settling to disuade future disgruntled associates from doing the same.
Had he, instead, hired Ben Crump or whoever to draft an MTD-proof complaint, send it to Covington, and tell them he's filing it and holding a press conference next week if they don't play ball, he could have gotten somewhere.

Covington & Burling LLP - (Specifically, Douglas Gibson, as managing partner), you have failed to:
1. Allow me to have a 1-on-1 conversation to discuss the fact that Kyle Rabe (the managing partner for legal personnel at Covington - a job that uniquely positions him to have special influence over the career of every corporate associate in Covington’s DC office) called me a “nigger”. This is an illustration of the same sort of failure in leadership that I was subjected to, and many others currently remain subject to, as an associate at Covington; and
2. Respond to my formal (and informal) requests to negotiate a settlement in a principal-to-principal negotiation. This lack of response demonstrates an unwillingness of Covington’s leadership to engage in constructive discourse about the dismal state of the firm’s policies and systems; systems which do not protect the corporate associates at Covington currently subjected to Kyle Rabe’s verbal abuse.
Given your failure to engage with me as outlined above, other than in a legal discourse (which, given your unwillingness to negotiate) will inevitably lead to an action in a federal court where you can use quiet, yet effective tactics to wear at my mental health (which you are aware is fragile) until I give up.
No Covington, I will not play into your strategy, and I hope the brilliant American people watching aren’t playing into as well by characterizing me as “crazy” for taking a unique stand.
Covington, I have carefully thought about what to do here since you are an undoubtedly formidable enemy. Upon consideration, I used the military decision making process paradigm to assess my options. Ultimately, I have decided that I will be using other, more effective, remedies than the federal courts in this situation because I refuse to play your rigged game in anyone’s court for the legally novice general public to see. I will not put my beautiful Black family through that. But I WILL tell you what happens next.
First, I will go on a much needed vacation with my girlfriend. During this time, you can continue to use your paid bots and your highly paid crisis management team to paint a narrative that I am “crazy” (which, as U.S. Army veteran, I vehemently detest) and that Kyle Rabe didn’t actually call me a “nigger” which is fine because I know that you refuse to take accountability here. Because of your greed, you prefer to “die with the lie”. But I know that Kyle Rabe clearly attempted to “put me in my place” when I told him that I was a better M&A lawyer than him (which is kinda true - just ask the associates in Covington’s DC office).
Second, I am going to attempt to publicly and privately connect to the executive administration, who has demonstrated an effective skill at making you and the other firms come to the negotiating table and actually negotiate, so that’s how I’ll try to get my deal.

My name is Paul Bryant and I am a Black, Neurodivergent former 5th year BigLaw corporate attorney with severe post-traumatic stress disorder. I recently experienced the most shocking display of attempted verbal abuse in my life at the hands of Kyle Rabe, a partner at Covington & Burling LLP.
Kyle called me a “nigger” after I defended myself and my reputation in response to him trying to pressure me to quit. I believe Kyle was directed by Covington’s management to pressure me to quit after I told Catherine Dargan, another partner at Covington & Burling LLP, that I would not write SEC disclosures in support of anti-minority and anti-women based initiatives. When I asked to speak to Covington’s management about this issue (along with other incidents nearing malpractice) I was stone-walled and eventually fired.
Out of embarrassment, hurt, and shame, I almost went away silently after Covington offered me a “settlement” agreement in which they offered to provide me resume writing services while they placed me on 1 week of administrative leave before I would have to unceremoniously “go try something else”. I did not even tell my closest friends this detail.
I hired an employment attorney to represent my interest in this matter, only to find out that this attorney had ties to Covington and I believe they attempted to convince me to settle the matter in exchange for a payment of one month compensation and walk away “for the sake of my family”.
I considered this option, but when Covington & Burling LLP began to unwarrantedly defame me to young impressionable Black attorneys, I knew I had to speak up.
This hurt and pain has caused me significant emotional trauma and I have not been able to look my beautiful, Black, 5-year old daughter in the face since this happened. I am ashamed that I have not found a way to fight this privately, so I am bringing this to light, knowing that I may experience significant turmoil.
Covington - I spoke with the last employee who tried to raise a harmful grievance against you so, I know how you attempt to use your partners and their connections to cause problems in people’s lives and the lives of their famlies. I have burned ties with my family, Covington…they hate me now, so do not mess with their jobs or their lives. They are not in play. I am your enemy, I am your problem. Face me, you called me a nigger…and now I am responding by telling you to say it again, out loud, right here.
For those watching the drama unfold, Covington knows that they cut off my compensation upon termination and that I cannot afford “big dog” legal counsel. So, I just want to say that if someone sees this, refuses to believe the lies that Covington is trying to spread about me and wants to help feel free to inbox or share.
If this isn’t your battle, that is okay too. I will fight this one like I fought every bout as a West Point boxer…alone, with my hands up, chin down, and biting down on my mouthpiece.

I am not sure what this "neurodivergent" means. He sounds like he refused to do legal work he was assigned. Does he have that right? Does one have the right to be employed by a law firm or can they fire you for refusing to do your work? I highly doubt that the racial slur in question was used.
