I didn't think about that angle as well, but given that male drivers currently earn significantly more than female drivers, I think that case is harder to argue. But it will be interesting. My understanding is that the reason that male drivers earn more is because the best time to drive for Uber is when the bars close, and female drivers don't want to let a bunch of drunk randos into their cars. If female drivers suddenly start earning significantly more than their male counterparts once this change goes into effect, the male drivers might have a case.

I was just trying to figure out who would have standing to sue Uber, dumbass. I could more easily imagine a scenario where a male passenger suffers damages because a female driver refuses to pick him up. Given that male drivers already earn significantly more on Uber, it would be hard to show that a male driver suffered damages because a few female passengers didn't want him to pick them up.

I'm not a constitutional lawyer, but my understanding is that gender-based laws get intermediate scrutiny rather than strict scrutiny for laws based on race. And when you consider the fact that female Uber drivers earn significantly less than male drivers and most of that is explained by the fact that they are scared to let random drunk guys into their cars when the bars close, I think there is a good chance that this type of policy would survive intermediate scrutiny.
