also they already do lowest-cost bidding and get burned by change orders and cost overruns. and the lowest-bidder system forces them to keep choosing contractors that have burned them in the past.

The way the system is set up for major public works projects, there is often only a few mega-corp's that will be available to do the job. There aren't enough bidders, and the one's who bid are the same type of over-staffed mega-corps. The bidding packages are drafted by engineering firms hired by the gov or public authority. They want to CYA (don't want to be told that project failed because you didn't account for everything in planning) and in some cases want to help the mega-construction corps that they have relationships with. So the bidding package will include these really detailed specifications for the project and over-bearing requirements.

A smaller construction corp with good leadership and a good track record would have to devote all of its staff to responding to the bid specs and even then has the risk of not winning (or even qualifying for) the bid. So the vast majority of companies are out of the running simply because they can't waste or risk the time with such bs. The corp's that can respond with a properly submitted bid have gigantic staffs dedicated to submitting bid responses. They're not going to bid low because they have a ton of overhead to cover.

So we already have major inefficiences here, even assuming nothing technically illegal. In NY, you've got additional considerations which will further drive up the costs. The unions and mega-corps know how to take care of their politicians and NY has very generous limits on campaign financing for state politicians. The public authorities here are often islands onto themselves. The incentives don't always align for the public authorities to keep costs down in their little fiefdoms. The safer bet is to keep the unions, engineering firms, and mega-corp's happy and pass the costs down on to the users.

In many ways, the strictures of the competitive bidding process can actually INCREASE costs for public projects. It becomes so difficult and expensive to submit a formal bid that only a couple of firms who have a big focus on gov contracts bid on the projects.

And it's not racial. The guys making out like bandits are well-connected working-class white guys. There's a whole host of issues here.
