A year or so ago they emailed me a dozen times that my account with them would be deleted and ALL my pictures LOST forever if I didn't "reactivate" because it had been so long that I logged in. These emails solicited me to sign up for their paid service to "keep your precious memories forever." They had a big 'countdown' in each email that was like, "Remember if you don't re-activate with us by January 1 your account will be permanently deleted and all your photos lost FOREVER."
I never re-activated. Just today, I received this email: "Your account’s been inactive, so your photos are archived for now. Keep your memories close—simply place an order to regain full access to your fast and FREE photo storage. Simply claim this special offer, we’ll do the rest."
They never deleted them! And surely they knew at the time they were soliciting me that they were not going to delete them. This is a material misrepresentation made to induce people to purchase their services sent over an interstate commerce thing by wire (World Wide Web e-mail).
Please send me your Client Agreement and we'll get started. No I may not have any damages but does that really matter anymore? It's emotional blackmail.
