You’re right about the dissent it’s definitely powerful!
Powerful opinion by Judge Oldham, arguing that interfering with Native American use of sacred sites on government property constitutes a substantial burden on their religious exercise. I'm grateful for his engagement with my scholarship, co-authored with Prof. Michalyn Steele. Judge Oldham is joined by Judges Elrod, Smith, Higginson, Willett, and Ho. I just wish he had written the majority opinion, not the dissent! Some day.
