Impact does matter because we're talking about a reaction, and also whether the Judges parking actually impacted someone. Parking poorly in a crowded parking lot is qualatively different than doing it in am empty one. It impacts how reasonable it is for the victim to initiate a confrontation.

Think about cutting in front of someone in a long queue versus an empty one. In a busy one the person is disregarding others to get an advantage, in am empty one the guy probably didnt realize.

And the fact that the Judge at worst made a minor faux pas is secondary to the fact that the victim initiated. It's similar to imperfect self defense. This is an odd impulse, but I am a little glad, since we're going through a period of federal district judges getting into weird trashy trouble, that we got a circuit judge, too, now. I didn't like the optics of it just being the district judges for some reason.
