Some degree is required, sure, but no country in the history of the world has come close to our level of economic rent extraction by means of regulation enforcement. It is harder to build a subway here than in Europe. To the extent our biggest asset has been a laissez-faire attitude towards letting businesses do what they want, that isn't the result of our enormously disproportionate (relative to the rest of the world) workforce of high paid lawyers. It's a consequence of a beneficial lack of regulation. But if we eg suddenly took a turn for a more European attitude towards business then who would enforce that and make money off it it? Lawyers.
To say nothing of the CSLG types who are responsible for perpetuating a hilariously inefficient system. They may be few in number but they have an overwhelming impact on the structure of our regulation |

Europe has way more and worse regulation and chokes entrepreneurship more. The more interesting example is something like China which gets stuff built from the top down - and can do eminent domain and build a subway with no environmental review, immediately. I guess we'll see if central planners always make mistakes such that they wish they had harnessed the power of the markets to price things and make capital allocation decisions
ps i'm not talking about CSLG types at all pps on most biglaw transactional work, i don't think excess regulation is a factor. sure you have antitrust. and some regulated industries. but most of the work is just writing contracts - maybe you think there should be some method for ordinary people to write complex contracts without lawyers - but i see it as more of a part of well-functioning capitalism |
