Gorsuch seems against Trump - from SCOTUSBLOG:

"Gorsuch: "We're tired of this legislating business. We're handing it all off to the president. What would stop Congress from doing that?"

"Gorsuch: "What would prohibit Congress from abdicating all responsibility to regulate foreign commerce—or, for that matter, to declare war—to the president?""

"This is the worst sign yet for the SG. If he's going to win, he needs Gorsuch firmly in his column. I think this non-delegation line of questioning is a big problem for the government."

"Justice Gorsuch just made the connection I flagged earlier: of all the previous "major questions" cases, the climate case (West Virginia v. EPA) seems the closest to this case, in terms of the connections between international affairs and domestic policy."

Seems like SCOTUS has an obligation to rule quickly on this one, seeing as how a majority clearly seems to think we've got a huge ongoing constitutional breach here.

I could be wrong, but the fact that SCOTUS is concentrating on non-delegation (Congress has no authority to delegate this stuff even if they are very clear in doing so) suggests that they want to stop Trump's "Plan B" of using other tariff statutes in the event he loses this case.

The problem is that would mean Congress can’t delegate its War Powers either which would be hugely problematic considering Congress has not declared war since the 1960s
