Persian waiter offered us ice cream then charged us for it

We had ordered the xo Borani, the xo koobideh lunch portion and the MFCR XO LAMB SHANK, everything was delicious. We’d been waiting a while for our bill so I flagged down the Jose that was cleaning the tables and asked if he could get our bill. As he was returning with our bill the Persian waiter shoo’d him away, approached us excitedly and said “You have to try our ice cream, it is sooo delicious. It has saffron and nuts in it.” We thought he was offering it on the house, but when we got our bill I noticed he charged $7.95 for the ice cream, which, by the way, was soooo CR.
We tipped him normally but just wondering what the Talmud might think about this situation. TYIA |

If Jose dropped off the bill at the table and then he said this, and they brought you a second bill after you ordered the ice cream, you’d have a better case |

Why should I have known whether the waiter saw my meal as complete? He had ignored us for at least 15 minutes after we finished eating our food. The Jose had already brought boxes and the leftovers were packed. Shouldn’t he have known that I thought my meal was complete for all of the mentioned reasons? |
