There are laws against brandishing and intimidation. If you attack me carrying a gun there's a more reasonable assumption that you might use it at some point to shoot me.
Say you punched a guy while open carrying and he shot you back. Is it murder? Probably not. Carrying is a Constitutional right. Brandishing and intimidation are not. Granted, Pretti did not do this. But by virtue of carrying a gun in general, and by committing obstruction, assault, battery, resisting arrest, what have you, there's an added escalation because you're armed.
Watch any cop bodycam video where they're talking to a witness and they asked to take their weapon away as precaution. They always say it's to protect both of our lives.
