the morality of the consequences of actions and the moral nature of individual human beings are two separate things. we don't imprison, expel, or kill the cold-blooded murderer because he "committed a cold-blooded murder." we act against him because he is the kind of human being who will murder again, and we don't want people to be murdered in our society, so we want to prevent him from doing so

we choose not to imprison, expel, or kill the woman who killed someone while texting and driving because she is not the kind of person who will likely kill someone again (unless she exhibits a pattern of this sort of anti-social inconsiderate behavior). there are of course many people (even within our own "legal system!") who want to "punish" people who break rules as a sort of "retribution," and would want to imprison this woman because of some vague incoherent emotional feeling that she "deserves it"

people have a really hard time grasping the distinction between the morality of actions in and of themselves, and the morality of humans as moral agents. in my experience people get more upset at me when i explain this distinction more than any of the other random "controversial" opinions that i have
